New technologies offer amazing opportunities to create, reuse and share content in learning materials. However this also means that universities and university staff involved in the development of online learning materials are more likely than ever to have to engage with intellectual property rights (IPR) and copyright.

For most people in education copyright and IPR can seem confusing and impenetrable and the task of clearing rights in content can be daunting.

This presents a number of potential challenges:

  • failure to correctly identify the rights in content and clear permissions accordingly
  • failure to correctly identify and assign the rights of staff and contractors creating learning objects
  • refusal to reuse existing content in the hope of avoiding rights clearance issues

As a result the potential to create engaging learning materials either isn't being fully realised.
