The following template documents include various letters, contracts and forms to help projects manage and clear all of the rights in their work.
End User Licence(s)
JISC Collections Open Educational User Licence V1.0
This licence can be used to provide access and use to materials being made available for Educational Use.
This is a standard open licence, developed with educational use in mind and allows for all use that is conducive to education and research.
As such any content made available under the terms of this licence, gives users the right to modify and adapt the content, to create derivative and collective works containing the content and to disseminate their work and deposit the content in repositories. In turn users must acknowledge you as the Licensor the content and this Licence.
It prohibits Commercial Use and any restrictions on subsequent use of the content that are not in compliance with this Licence.
Rights Clearance
Model Rights Clearance Licence - Authenticated Access
This licence should be sent to Rights Holders when seeking to licence their material for educational purposes and subsequently make that material available via a secure network. The licence covers deposit in Jorum and other repositories in perpetuity as well as a wide range of educational use and re-use, including the creation of derivative works. This is a non-commercial licence and all commercial use is prohibited.
It is not advisable to send the licence to a Rights Holder 'out of the blue'. This is a document that will be used as part of a dialogue with the Rights Holder regarding the permissions and rights that you are seeking from them. However, it will allow you to help make their life easier by having a licence ready to use that has been drafted by experienced legal counsel.
Model Rights Clearance Licence - Open Access
Similar to the licence above however the licence granted will allow the materials to be made publicly available anywhere in the world for educational purposes, including the creation of derivative works and the deposition of materials in JORUM and other repositories. This is a non-commercial licence and all commercial use is prohibited.
As with the licence above it is not advisable to send the licence to a Rights Holder 'out of the blue'. This is a document that will be used as part of a dialogue with the Rights Holder regarding the permissions and rights that you are seeking from them. For low risk materials, this letter should be sent to Rights Holders to request permissions from third party rights holders that will allow the material to be included in learning objects being made openly available anywhere in the world for educational purposes.
